    That means your son is also able to file 485, right? In that case he will not age out once an AOS is submitted for him. I am assuming your 140 will be approved before he turns 21.

    Hi All,
    I want to know if my 19 year old son can be affected by aging out.
    I have just received ALC certification and will now file I140 and I485 concurrently as my priority date NOV 22 2004 EB3 Rest of World will be current in June.
    Can someone who understands the aging out rules tell me if my son may have a problem?

    My application was finally approved yesterday after almost 7 years in queue. Here is the sequence of events right before the approval.

    RFE email on 02/13/09
    2nd Biometrics Notice received on 02/17/09
    Lawyer receives RFE for EVL, EAD cards and Marriage Certificate on 02/24/09
    Completed Code 3 Biometrics on 02/26/09
    Soft LUD immediately after Biometrics on 02/26/09
    USCIS receives RFE reply on 02/27/09, Hard LUD and email on the same day
    Another soft LUD on 03/02/09
    CPO email on 03/10/09
    Welcome email on 03/10/09

    My PD has been current for a long time, but my application had not been touched and then suddenly USCIS became a model of efficiency. I am sure they are opening applications and approving or RFE'ing all they can. Hang in there guys.

    It is a letter by your I-485 attorney to USCIS mentioning your pending I-485 application (receipt numbers, filed where, including everyone part of the application), about your company securing I-140 approval under EB2 category for you and requesting to interfile this I-140 with pending I-485 and approval based on case is being current now (mentioning priority date). Copy of the I-140 approval notice (EB2) should be attached.

    Some attorneys do attach I-485 receipt copies too. Also, your attorney may ask you to sign on the G-28 form that he/she is representing your case.

    This will depend on two factors

    Demand from EB1 and EB2-ROW
    USCIS allocation strategy (Quarterly spillover or year end spillover)

    From historic data I have seen some 15-25k visa spillover to EB2/EB3 India-China, this number varies based on demand of various EB categories each year.

    With H-1B cap coming down in 2004 to 65000, demand should go down by a decent margin post 2004, since its the H-1B's which will lead up to the EB queue.

    By the way Sachug/vdlrao, do we know if this will be yearly or quarterly spillover. If it is year end, what does this mean? September or July(beginning of last quarter)? And I am sure there is documentation about this new horizontal spillover method from USCIS, but I can't seem to find it. Could someone point me to that. Thanks!

    You can change the assumption of the calculations. 750,000 are anticipated number of applicants. Now, even if u reduce it by half, i.e. 375,000, the wait could be more than a year long.
    Plus we do not know if there are 10 or 100 people working on EAD stuff. Lower this number , longer would be the wait.
    I don't believe all 750000 are EAD wannabies!

    Did anybody notice this in the IRS communication that was sent out to taxpayers:

    For taxpyers, the amount of money will be "reduced" or " completely phased out" for individuals making adjusted gross income or more than $75K ( or more than $150 if married and filing jointly).

    How about that?

    Not surprising. People who earn $75K (single) or $150K (as a couple) are not the ones who drastically change their lifestyles because of recession or high gas prices. In fact these people are anyways earning much above the national average. It's the low/middle-income folks that bear the brunt of high inflation and soaring gas prices...they are the ones being goaded into spending.

    Anyways, think twice before you spend the rebate foolishly. Why not send it to IV, contribute to an IRA or fund your kid's 529 plan?

    Instead of hiring a full time lobbyist why dont we hire a full time manager who will contact IV members and drive funding drives , organize campaigns , send and spam USCIS with emails flowers and faxes and keep it moving. Heck may be we can even offshore and outsource it. Take a look at YourManInIndia (http://www.yourmaninindia.com/) . At 7$ per hour this wont take much.     They also respect and obey the laws, even though there are stringent scrutiny and limitation imposed. For example, they wait for years to complete the legal process, during that time, they cannot travel abroad without the serious risk of being denied re-entry. Having committed no crime, they have to notify the government every time they change their place of residence � something that, among American citizens, only convicted felons are required to do. They have spent hundreds, sometimes thousands, of dollars on government-mandated application fees and related costs. They have underwent inordinate amounts of stress making sure their applications were complete and properly filled out in every way, knowing that any error or omission, real or perceived, could get their application automatically rejected. Through it all, they had faith in the system of legal immigration. Now they are being penalized for following the law and for having faith in the system, because the federal government has dealt with them unjustly and deceptively. Such a way of dealing with prospective legal immigrants is sure to deter other highly skilled, intelligent people from wanting to live and work in the US, to the detriment of our country.

    I request that you investigate and work to improve the procedures for legal employment-based immigration. Specifically, I strongly urge you to support the highly skilled people who are seeking legal employment-based immigration because they are actively contributing and improving the (YOUR STATE) Community and the greater American Society.

    and in some cases as long as 20-25 years, before he or she can even get a Green Card,

    Pankaj, the writeup is spot on except for the above. I am not sure it takes anyone in the EB category, 20 years to get the GC. It may happen in the future if retrogression is not fixed.

    IMHO, it is important that we stick to facts when we write articles/op eds etc.

    Processing dates for 485 seems to have greatly improved at NSC. Hopefully now they start issueing based on the priority date.

    At NSC I am seeing the following entry

    What does 4 months mean?

    Check the forums for a link to a document that indicates that Banks do accept EAD, etc.

    I have refinance with BoA and it went thru just fine. I tried to find the correct link but haven't found it yet. If i do, i'll send it across.

    But do a forum search for refinance, etc.
