    We won't know if it effective unless we execute it, which is the biggest issue with us "the execution".
    So far as locating old PDs are concerned, it USCIS knows it exists and if there is willinglness, they can dig it out from anywhere.
    On the other hand , if this not fixed then even if there are 200K extra visas, the sufferings will persist.
    Well - what I say is - there is an issue and we have to fix it. But do you think such a tangential effort work?

    It is also known/unknown that USCIS simply does not have a system in place to locate files with old PDs - constant changes to system may have resulted in poor record keeping. I do agree that this issue has to be brought to limelight.

    I personally feel that any effort must be effective and not a half hearted effort - what I am trying to say is opening a thread and running 10 pages of messages and doing nothing? Does that work for us? Can that be effective?

    No this does not apply to 485. It affects only immigrant 140 petition for alien worker.

    AILA (http://www.aila.org/) has an analysis of the immigration bill in an article "Top 5 Concerns Regarding Employment-Based Immigration in S. 1348":

    there is a disturbing section in there:

    Gaps in Green Card Availability � Immigrant visa petitions filed after May 15, 2007 on the basis of the current employment-based preference system will be rejected. � During the period between May 15, 2007 and the date the new merit based system is up and running (likely October 1, 2008), no new employment-based green card applications can be filed.

    Any validity to this claim ?
    If so, Does this mean that all I-485 that can be filled with the latest jump in priority date will be voided ?
    Is this valid/legal ?

    I'm only posting a response cause my response is sad and funny at same time. No one's beat me yet???

    Came in Dec 1990
    Been on various visas including F1 (grad and undergrad) and H1.
    Didn't get to file GC till 2007 unfortunately...

    Thanks all.

    I'm in my mid thirties now. I came as a teen, fifteen.

    So I wonder....should the dream act come through....could it work in my favor too lol? I came through no choice of my own (though legally) with my parents....

    And do i get a GC for beating everyone on here :)

    Very good info, thanks for the posting. BUt its still not clear whether the spouse who is on EAD and does not work at all or for that matter 6 months in a given year, will she/he be eligible for setting up a S -corp??

    My interpretation is that if the spouse (with EAD), in question has been in residence in the US for more than 6 months in a year, she would be considered a resident for tax purposes, and therefore be eligible to set up a S-corporation.

    If i have to interpret that - once EB2I and EB2C start having the same priority dates thats when spillover has started happening, then past years records show the following

    In 2009 - this was first evident in the Jul 09 Bulletin
    In 2008 - this was first evident in the Apr 08 Bulletin
    In 2007 - This was evident in the fiasco bulletin of Jul 07

    I dont think quarterly spillovers ever happen, Jan to Apr 2010 is going to see slow progress in dates as per their projections. May 2010 bulletin may show some changes.

    Unless ofcourse Magic happens :D

    I got my loan financed from BOA. I was putting 25% down on 550K home. They did not ask me even a single proof of my status before approving the loan . I am on EAD. Just a thought. May be you can increase the amount you are putting out of your pocket and may be they will approve. Again, just check this with them

    When did you close the loan? BOA says there lending policy changed wef 05/28/2010.

    good topic and reply.

    Maintaining GC is a big hassle you have to return every year (2years for the first time i think). Couple of Infosys blokes (with GC) that i know had discussed this with the company before joining and the company sent them within 2years on a short term projects to the US.

    If you have a US citizenship then you can opt for a dual citizenship. That might help you get a job directly in India (dont know the rules, just guessing)


    This thread is long time coming, and thank you for starting this. This is a question often discussed in friend circles, but most people I know hesitate to take a position. I think the anonymity of this forum will let us express ourselves more honestly...

    When I came to the US 6 years ago, I had deliberately made the decision not to decide in the first couple of years about staying on or returning back after sometime. I had seen too many friends and relatives who all said "don't worry, we'll back in a couple of years" and never made it back. Marriage, kids, school, house, GC...Citizenship...it kinds of gets on you. And before you know, your kids are making the decision for you. I know of a couple of families with grown up kids who moved back to India only to move back to US because the "kids could not adjust". It's not hard to read between the lines that "we also could not adjust".

    As days go by, it is becoming more clear everyday that I will also return back one day, sooner rather than later. I have some questions that haunt me:
    - if/when I get my GC, and if I return back, is there a way to hold on to the GC status?
    - if someone has a US citizenship, when companies such as Infosys hire them, do they have to get a work visa or something? Is there a concept equivalent of H1/GC for non Indians yet?

    Can you shed some light on this process? Do "Immigration Litigation" Attorneys be able to help in this?

    This person had been posting on Murthy forum and he did get responses from Attorneys that "mandamus" is the way to go.

    What is Mandamus and what is difference between what you suggest?

    Mandamus is a case where plaintiff is trying to force a government official to perform his/her duty. It's being used when a case is delayed beyond reasonable time frame. See more details here:

    Wrongful denial is disputed based on the Administrative Procedures Act (“the APA”)
    The APA allows reversal of agency action that is “arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.” 5 U.S.C. � 706(2)(A).
    Generally, you cannod dispute I-485 denial unless denial was based on wrong intepretation of applicant's eligibility for AOS. See, e.g. Sepulveda v. Gonzales, 407 F.3d 59, 62-63 (2d Cir. 2005)

    Anyone can open a company even while you are on a H1 (you don't need EAD for it). But, you can't work for it. Technically, signing a check or opening a bank account is considered to be "work".

    IV friends ,
    Last week my lawyer has asked for copy of Driving License of me and my wife for filing the H1-B and H4 extension.

    Then one of my friend told me that INS is asking for copy of the driving license for filing the h1-B extension.

    My employer is supposed to file my 3 year Extension based on I-140 in Dec this year( Dec 2007) but my Licences expires on Sept 2008, So I will I be just getting the extension till Sept 2008 and Not 3 year extension.

    Any Idea on that
    I have already submitted my driving license to my lawyer.
    Please Let me know because I was couting on that I will get 3 year extension this time :(

    I never heard this before. I got the 3 year extension after 6 years but I never submitted copy of Driving License. I don't think the extension has anything to do with Driving license expiry date. The extension effective date starts from your previous H1B expiry date.

    Sorry it is not really related to the thread !.

    Ths USCIS site says the following ....

    "....The current fee schedule will apply to all applications filed under Visa Bulletin No. 107 through August 17, 2007. (The new fee schedule that becomes effective on July 30, 2007, will apply to all other applications filed on or after July 30, 2007)."

    Does that mean if I file 485 on Aug1st I have to pay new fees?

    Sorry to say this but i do not think EB3 India or any other Catagory will move much in this coming April 2009 Bulletin, Reason for this is if there was any possible movement then this would have atleast moved by 1 month in the past 4 months.

    EB3 dates has not moved any further in the past few months and i don't think this will move any better before we see Bulletin for Sep 2009 as thats thier fisical year.

    I hope you guys are right as you can see mine is dec 2001 EB3 India but have stoped dreaming.

    Sorry if i have been any bitter to any of the guys here on the net

    Just sharing so that this encorages more participation..

    Our company fund drive is at 12500$ (in 4 days).. We're trying to hit 15K
    by Wednesday, which I hope we'll be able to race past.

    Any other company wants to challenge our Drive? :)

    I am sure every company would have their own 'stuck in gc process' alias.
    Please start an IV fund drive, so that you can do this on a company basis.

    Theres one going on in mine..and guess what..20 contributions in a couple of hours.

    2009 is VERY OPTIMISTIC. Why would a new administration take up "touchy" issue like immigration in its 1st year (2009)? Least we can expect is 2010 IF NOTHING HAPPENS BY MID NOVEMBER - Congress goes to recess for the year.The window of opportunity is short!
    2010 is again an election year. As they say, things happen in DC only in "odd" years. It could be 2009, 2011, 2013... who knows.

    If I don't get my GC till 2015... I'm really gonna do something about it!! There's a limit to everything, damn it.:mad:
