I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

Hi,
I have filed my 485 on July 2007. I am currently working using EAD and last time entered US in Feb 09 using AP. My current AP is valid till Oct 17 2009. I will be going out of the country for few days in early Sep. I wanted to know can I apply for my renewal of AP now. I read the following in the I-131 filing instructions (page-4)
If you travel before the advanced parole document is issued, your application will be deemed abandoned if:
1. You depart the United States; or
2. The person seeking advance parole attempts to enter the United States before a decision is made on the application
So can I apply for my AP renewal now (I am assuming if I apply now it won't get approved before my travel in Sep) or do I need to first complete my travel in Sep, come back to US and then apply for the renewal.
Please reply.

With my knowledge, I don't think your current salary should matter for the future employement. But it shouldn't be grossly differrent. One of my friend got his GC approved with H1B salary less than salary mentioned in I140. What I would like to say is not worry to about it much until your attorney says it is a problem.

I got my H1 approved in Oct 2004 and it was from Oct 2004 - Oct 2007. I used only 6 months of H1 and later went on TN (work visa for Canadian citizens) and remained in US working on TN for 4 years. I was in US all these years. Now even the earlier H1 approval duration is over, Can I apply for H1 with another employer using the old 2004 H1 quota cap or it has to be under new 2009 cap? Thanks in advance.

According to a FAQ on Murthy.com about the Yates memo, it is possible to switch jobs (using AC21) if 140 and 485 have both have been pending 180 days. Murthy doesn't advise this under normal circustances because if an RFE is received on the 140, then it is problematic if you've left the company.

Hi,
I am currently on H4 and had to file my H4 Extension as my current H4 was expiring. At the same time I also filed for H1B in 2008 and was picked up in the lottery. Now I am confused on which application the USCIS will consider.
Will it be H1B or H4?
If my H4 extension is approved after H1B will my status then becomes H4?
if H1B is approved after H4 will then the status becomes H1?
Is there a way that I can make sure the status at the end I have is H1B?

I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.
Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?
4. Will there be any problem if i add my wife (Assuming she is on F1) to pending I485?

My wife dint work for a while on H1 status,but changed back to H4 after working for 6 months with change of status from H1 to H4 at INS..so currently she is on h4..

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....
