She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

Hi,
I am currently on 8th year of H1-B, employer to file for 9th year H1 extension next week. Labor filed in Dec 07, denied in Jan 10, appealed immediately. Currently awaiting response to the labor appeal. H1 expires in Jan 2011.
I work for a consulting firm and my client has been requesting me to join full time as an employee, willing to transfer H1 immediately. My question to the experts is
If I change employer, will I have to start everything from scratch or can i continue the GC from where my current employer left?
And given the current political situation (due to the economy), should I stick to current employer until H1 extension goes through and then make a move (if any possibilities exist)?
Any advise is much appreciated.

Sorry for the cross posting.
My papers were sent on June 21st, but they were receipted only on June 27th. Turns out USCIS returned my $1000 for premium processing :(.
My lawyer said they talked to USCIS and USCIS asked them to re-file with proof of receipt.
Did anyone who filed in end June have their 140 premium processing returned?

Currently, I am working with software firm (not a contract work). My wife is re applying for H4 visa. she applied for h4 last year in Feb, i used to work with contracting firm then and refused under 214b(immigration intent). This time we are applying through attorney. Attorney have sent email thrice to Islamabad consulatein Pakistan stating that denial under 214(b) for H4 is not valid reason.
But no response from them.
However my wife is applying again and taking letter with her from attorney stating that reason was invliad.
I am wondering
1- Do we need to highlight the previous denial so much as she is applying on new h1B now
2- in any case, can they revoke and cancel my petition as if they do not find any valid reason to reject again.
I am looking forward to hear from you

I need advice from Gurus who have experience or gone through this. I am on H1B with pending I485 and i got married recently. My spouse is on H4.
I have been looking for a job and my employers want to hire me on EAD. If i use EAD, then my wife will be out of status.
Other option is for my wife to get into F1 status.
1. How easy to change the status from H1 to F1?
2. Should i wait to use my EAD till my wife's F1 status gets approved?
3. If the change of status gets denied, will there any problem to her H4 status?

I asked my attorney if we could anything about the delay in the issuance of EAD. My attorney mentioned that she would send an e-mail to USCIS. Is there an e-mail id that attorneys use to contact USCIS ? Offcourse, I could have asked my attorney, but I thought I would post the question here first.

Here is my current status :
6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. My attorney is asking $500 for filing both EAD and AP as filing fee. So was wondering how difficult it is to file by my self. Does anyone has expereince filing for renewal.?

My GC was applied with employer A in Nov-2005. 485 applied during July 2007 fiasco. Even though I have EAD/AP, I have always maintained H1B status.
Recently got H1B transferred to employer B and its approved for 3 years.
My H1B visa (from employer B) will expire this month.
Can I make a trip to India and re-enter using AP, and still maintain H1B status?
I dont want to go through the hassle of going for H1B visa stamping for 10th to 12th year.
