Hi,

My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009

In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time

Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.

What are the best options for H1B refiling case

in case if it is denied, will it super impose the original H1B approval ?

is it good idea to cancel/revoke pending H1B refiling case ?

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

No, you can not. there are lot more factors than your qualification.

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.

Does this happen often ?

I would be concerned if you don't see anything in the mail by end of this week at the latest.

My son came to USA on H4 Visa. He completed his studies on F1 Visa and worked for some time on H1B Visa.

Then he went to Canada for higher studies. He holds Canada PR.

I am in US. If I apply for his I 130, would there be probem him visiting US on B2 Visa.

I am planning to visit India soon. I have my AP and an expired F1 visa.
I haven't been to India since I got my H1 approved; so I don't have an H1 visa stamp on my passport at all. My I-797 is approved until 2010.
Can you please advise if I should get my passport stamped with my H1 or should I be ok with my AP?

My employer is a single architect and owner of his sole proprietorship LLC firm and he filed an EB3 I-140 for me submitting the "Schedule-C" of his tax return, which shows a net profit of $57000 for the company. The prevailing wage for my architectural technician position is $35,100, and NSC is asking for my employer's personal financial documents, saying that they are not satisfied only with "Schedule-C" and �Net Profit� of his tax return and a sole-proprietor petitioner has to prove that he can sustain his household and the proffered wage. Can USCIS ask for personal finances when the net profit of the company is clearly greater than the prevailing wage? Has anyone been in the same situation? Any suggestions from the gurus?

Dear Attorney,

Below are my details:

Current work status : H1B
Applied for I-485 , July'07 filer, priority date: jun EB3 category

My husband details:

Current work status : H1B
Applied for I-485 , July'07 filer, priority date: Feb EB3 category

We both have separate EADs and H1B visas and are independent of each other currently.

Because my priority date is 2006 and my husband's is in 2005, there is more possibility that he may get GC before my PD becomes current.
When my husband's priority date becomes current, he wants to file it for me again so i would get GC along with him.

I am now considering to look out for jobs and use my EAD card with new employer.

Can I make my EAD active ? Will it cause any problems when my husband's priority date becomes current and when we file my application along with his ?

Any input is greatly appreciated.

Hello,

My I-485 was filed this July. My wife and I got FP notices for Nov 20. But my wife is currently in India and I will be in India too on Nov 20. So we will have to reschedule at least for my wife.

My question is, has anyone who filed their I-485 after July 2 rescheduled their FP appt and got a new appt date? I'm in the San Jose area.

I have a question regarding location change with same employer. I have labor approved on EB2 India with PD 01/2005. I am employed with a big health care firm which has various locations in the region. I'd like to move to another location which is 30 miles away from my present site. I140 is pending with the same employer. I have also posed this question to my lawyer but appreciate greatly if anyone knows answer to this. Will this affect my GC?
