I have applied for my PERM Labor Certification on Aug, 6th'07. My status online shows "IN PROCESS". DOL called my employer's contact to verify submission on Aug, 15th'07.
My Lawyer states that rather than preparing for I-140 / I-485. I would be best served in working on preparing a response to the audit that will be coming, because of the Spanish language requirement.
Is he just getting ready for a "just-in-case" audit...? Should I prepare the I-140 and deal with the audit on the 30-days if DOL sends the Audit letter? How long would it take to receive this letter?

Purpose - H1B Visa Stamping(VISA Approval in 2008 before had F1 Visa)
Interview - VO Asked me few Questions and then asked me to show your company's Wages report and your consultacy and client where u worked agreement letter. I have given him both the docs. and Vo kept with him and gave me 221G Yellow letter which mentioned your docs. are in administrative processing and didn't mentioned any time frame.
After my Employer and i frequently sent emails and faxes to mumbai consulate but no response yet.
Anybody Knows what i have to do. Please advice me further .

I have recently been laid off from my job, I'm thinking of pursuing a associate degree course from a nearby community college and change to F1 status. I already have a MS degree, Would it be a problem for the change of status?

If you have EAD, H1 & H4 can work in your own business and work in current H1.
H1 & H4 (without EAD) forget about starting business and sit in your own company/shop/gas station etc.... & MAKE MONEY. This is the fact.
Question: Can person A on an H1B start own business while continuing to work with current H1B job? Can the business be not related to ones profession? Can a person on H4 visa start his won business too? Any answer is appreciated!

I am currently attending a college here in China. However, I have been offered some interesting jobs . These jobs require that I have a resident visa. I have been told that I can't change from a student visa to a resident visa, while in mainland China. Is this accurate? If so, is Hong Kong an option for me?

My current employer 'C' is in the process of filing Labor certification. I have to fill out Form # 9089 and give it back to my employer with past employment specifics.
I left my past employer 'A' on 9/23/2005, though was paid till 9/30. For the next month or so I was at home looking for a job on my own. When I did get successful I approached a consultant 'B' who filed for my H1-B transfer and offered me a appointment letter. We together kept looking for a job till 11/29 when I actually started working. When I got experience letter from these employers they told me that it is from the start of project date that you were on payroll. I am also sure that my employer 'A' did not inform the INS immediately but took about 15-20 days to send a letter after I had left.
My question is what dates should I put on the form, the actual dates or the ones I have on appointment letter

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

I am on an O-1 visa married to a G-4 visa holder working for an international organization. My spouse's work told her recently that her spouse and other dependents have to be on a G-4 dependent visa unless they are a US citizen, green card holder or on their own G-4 visa.
1. If I change to G-4 spouse visa, I would have to wait 4-6 weeks before I get an EAD to work. So, I want to know if this is indeed true.
2. Can I continue to work on my O-1 until I get the EAD? Is there any way to expedite the EAD process.
3. Plus, I want to know about the portability of the EAD I can get through a G-4 visa.
4. Also, would this restrict my ability to apply for a green card in the future.

I had my I-485 interview at Boston-CIS in May,2007 and since then they were telling me lots of BS like NC, One security check open, additional review. Finally they sent me a letter telling me I need to attend NSEER interview at ICE office in Boston and I did that this week and the nice ICE officer told me that he was sending my file back to NSC. Last time I saw that thick file was when I was interviewed by IO at Boston-CIS!. Does it mean NSC will approve it now? I'm EB2 ROW and I was never finger printed more than once. So far had 2 EAD/AP and I applied in 2006 August

Of my 5 year experience
4 years is for My Company (India) Ltd
1 year is for My Company (US) Ltd.
Will my total experience be treated as progressive and can I process in EB2 category?

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.
